This case is one of a large number that was stayed by the Upper Tribunal to await the Supreme Court's decision in the Reilly and Wilson appeal. Although that appeal was decided on 30 October 2013, two other important legal issues have arisen in consequence of Supreme Courts decision that potentially affects this case and all other stayed cases.
In order to sensibly progress all the stayed cases, the Upper Tribunal has selected nine lead cases to rule on the two other important legal issues, and will continue to stay the other cases in the meantime. This case is one of the cases that will remain stayed.
What this means is that, unless an application is made for this not to happen (with reasons given in that application why this ought not to be further stayed), the Upper Tribunal will take no further action to decide this case until the issues in the lead cases have been decided. Directions will then be issued on how this case is to be progressed.
If you require any further information about the issues that are to be decided in the lead cases please write to ask for this to be supplied.
